It is important to stress that, in the event of a controversial land use application, the sooner the client or opposed party consults with counsel, the more likely a successful result will occur, because many issues must be raised before a land use board prior to litigation in Court.
It is also important to understand that land use cases typically begin before a municipal board, then are addressed on an Appellate level before the Superior Court, and finally at the New Hampshire Supreme Court. If facts or legal issues are not developed before the municipal board — e.g. a party does not contact counsel until after an unfavorable municipal decision — it may be too late.
